National Economic Prosecutor (FNE) Market Study on Medicines

In the exercise of the powers enshrined in DL N ° 211 that Sets the Standards for the Defense of Free Competition, the National Economic Prosecutor’s Office (“FNE”) published today the preliminary report of its market study on medicines (“Report”) .
The Report – initiated in April 2018 – aims to analyze the market for medicines globally, including from the production of medicines to their distribution through various channels.
In this regard, the Report especially analyzes – among others – the classification and basic terminology of medicines; the history of the commercialization of medicines in Chile and general regulatory aspects; the markets for marketing and retail distribution of medicines, including their regulation, operation and competition; the particularities of the public market; and factors that influence market competition.
Finally, the Report presents recommendations for measures (14) whose application – in the opinion of the FNE – allows a structural reform of the industry, through the implementation of a regulation that promotes more competition in the reference market, and – as a consequence – ensures the population’s access to medicines at a lower price.
