Diario Financiero published the column “Desalination Law: Pending Challenges for Its Proper Implementation”, written by our senior associate Martín Vial, which analyses the main tensions in the implementation of this new regulatory framework.

The article addresses how, although the law seeks to facilitate the development of smaller-scale projects, the lack of definition of key concepts—such as “industrial-scale” and “intensive”—together with the coexistence of pre-existing triggering criteria under the Environmental Impact Assessment System (SEIA), could affect the achievement of this objective.

In particular, it warns that, absent regulatory adjustments, a scenario may arise in which projects that the law intends to exempt ultimately remain subject to environmental assessment.
