Cybersecurity | Second Preliminary List of Critical Infrastructure Operators

Launch of Public Consultation
As part of the second stage of the first classification process for Critical Infrastructure Operators (OIV), the National Cybersecurity Agency (ANCI) issued Exempt Resolution No. 85, approving the preliminary list of entities classified as OIV and initiating the public consultation process, in accordance with the provisions of the Cybersecurity Framework Law and Supreme Decree No. 285 of the Ministry of the Interior and Public Security.

Included Strategic Sectors
• Transport, storage or distribution of fuel.
• Supply of drinking water or sanitation services.
• Land, air, rail or maritime transport, as well as the operation of the corresponding infrastructure.
• Other public service concessionaires.
• Administration of social security benefits.
• Postal and courier services.
• Production and/or research of pharmaceutical products.
• Essential services included in the stage initiated on 30 May 2025, provided by entities not included in the first preliminary OIV classification list.

Key Obligations of OIVs
Entities ultimately classified as OIVs must comply with an enhanced cybersecurity obligations framework, including:
• Implementing a continuous information security management system to assess risks and incident impacts.
• Maintaining records of actions carried out within the framework of such system.
• Developing and implementing operational continuity and cybersecurity plans.
• Conducting ongoing reviews, exercises, simulations, and analyses of their networks and systems.
• Adopting immediate measures to contain and mitigate cybersecurity incidents.
• Obtaining the cybersecurity certifications required by law and by ANCI.
• Notifying potentially affected parties, when required by ANCI, of incidents that seriously compromise their data or systems.
• Developing ongoing cybersecurity training and awareness programmes for employees and collaborators.
• Appointing a Cybersecurity Officer.
