What you need to know about the subdivision of rural properties

July 27, 2022

The purpose of Decree Law No. 3516 of 1980 is to allow the subdivision of rural land suitable for agriculture, livestock or forestry purposes, and the agricultural use of the land must be maintained.

However, the subdivision of rustic land in accordance with DL 3516 has been questioned from different sectors because it is considered to be an incorrect use of agricultural land subdivided for housing purposes. That is to say, it is questioned that through this regulation, whose purpose is the division of rural land, real estate projects are being developed outside of territorial planning.

Given the criticism of agricultural land subdivisions under this law, some authorities have issued resolutions that seek to discourage applications for land subdivisions for purposes other than agricultural or forestry development.

Barros & Errázuriz’s Urban Planning group prepared a report detailing the above.

We invite you to review it here.
