Comprehensive Elderly Persons Law introduces new employment contract for older workers

June 24, 2026

Law No. 21,822, known as the Comprehensive Elderly Persons Law and the Promotion of Dignified, Active and Healthy Aging, was published in the Official Gazette on June 1, 2026. The law will enter into force on June 1, 2027, and establishes a range of measures aimed at promoting the inclusion, protection and active participation of older persons.

From an employment law perspective, one of the most significant developments is the creation of a new Older Worker Employment Contract, which may be voluntarily entered into by individuals aged 60 and over.

Key features of this regime include flexible working arrangements through alternative scheduling options, the possibility of temporarily suspending the employment relationship without affecting seniority or accrued rights, and the ability to take annual leave in advance on a proportional basis after the seventh month of employment.

The law also requires that the employee’s duties be compatible with their physical condition and capabilities, reinforcing employers’ obligations regarding workplace health and safety.

The delayed entry into force of these provisions provides employers with time to assess the impact of the new framework and adapt their employment policies and practices accordingly.
