On February 1, 2024, Supreme Decree No. 30/2023 of the Ministry of the Environment was published in the Official Gazette amending the Regulations of the Environmental Impact Assessment System. This amendment is made in order to (i) incorporate the climate change variable in the evaluation of projects or activities subject to environmental assessment, as well as in the review of the Environmental Qualification Resolution (hereinafter, the “RCA”), as required by Article 40 of Law No. 21,455, Framework Law on Climate Change; and (ii) ensure effective community participation in the environmental assessment process, in line with the provisions of the “Escazu Agreement” ratified by Chile.
