On January 15, 2026, the Resolution No. 5,357 of the General Water Directorate, dated December 30, 2025, was published in the Official Gazette. This resolution sets forth the list of water use rights subject to the payment of non-use water rights fees for the 2026 process (Articles 129 bis 4 et seq. of the Water Code).

The fees must be paid by March 31, 2026. Failure to do so may result in the auction of the water use right through an executive collection proceeding.

If the resolution contains errors—such as duplicate fees—or if it includes a water right that is currently in use or that qualifies under any of the statutory presumptions of use set forth in the Water Code, a motion for reconsideration may be filed within 30 administrative business days from notification. This deadline expires on February 26, 2026.
