Practical Considerations of the lifting of Dark Patterns in e-commerce

In August of this year, the National Consumer Service (SERNAC) published a report on the rise in the use of Dark Patterns in a sample of the companies participating in Cyber ​​Monday in November 2020. This report represents a first approach by SERNAC to examine these behaviors, and whose later stage considers the realization of a study on which of these dark patterns would violate the rights of consumers recognized in Law No. 19,496 on Protection of Consumer Rights (Consumer Law) and that could be a matter of inspection or investigation in a case in which the collective interest of users is compromised.
