María Fernanda Espinosa addressed the implications of the use of IA tools and its impact on human resources at the Latin American Employment Summit

Our labour partner, María Fernanda Espinosa, participated as a speaker at the Latin American Employment Summit, organised by International Employment Lawyer, on the panel entitled “Internal and external AI threats”, last Thursday.

The event brought together high-level in-house and private lawyers to explore the challenges and opportunities faced by multinational employers and their legal advisors across the region.

During her presentation, Fernanda elaborated on several key points related to artificial intelligence (AI) and its impact on human resources (HR) processes.

In this regard, Fernanda argued: “It is essential to understand that AI programmes are built and then trained with real data. If this seemingly neutral data is not properly reviewed or other variables are not incorporated into the programme, AI can reproduce human biases.

On employers’ duty of transparency, she added: “Employers must communicate transparently with employees about the types of data collected, the purposes for which it will be used, and their rights to access, correct or delete their information, ensuring that all employees understand and agree to this.”

Furthermore, Fernanda stressed the importance for companies to remain vigilant, ensuring that their AI-powered HR technologies are designed and implemented with strict data privacy standards: “Companies must therefore be vigilant, ensuring that their AI-powered HR technologies are designed and implemented with the strictest data privacy standards in mind”.
