Amendment to the General Ordinance on Urban Planning and Construction

November 4, 2026

On October 2, Supreme Decree No. 68 of 2026, issued by the Ministry of Housing and Urban Development, was published in the Official Gazette, introducing amendments to the General Ordinance on Urban Planning and Construction. The decree aims to modernize and update the regulations while expediting reconstruction projects in disaster-affected areas. It introduces significant changes in areas such as density, parking requirements, integrated developments (conjuntos armónicos), road impact mitigation reports, and risk assessments.

Key changes include a reduction in the coefficients used to calculate density for projects located near public transportation stations and major roads. The decree also relaxes the requirements for integrated developments, allowing greater increases in buildable area and building height, and establishes a simultaneous building permit and final approval process for housing reconstruction. Additionally, it includes a transitional provision allowing projects with valid permits to benefit from the new regulations within a two-year period.

In this context, our Urban Planning Law team has prepared a summary of the decree’s main provisions and their practical implications for real estate developers and investors.
